My lender flagged that the broker on a deal I'm financing has both sides of the transaction and asked me to look harder at it
I'm on the debt side here, not buying, but the lender's concern caught my attention. Bridge loan to a flipper, single family in suburban Maryland, $340k purchase. The listing broker brought the buyer too, and my borrower did not flag this to me when we talked through the deal. Found out when the lender's counsel sent over the purchase agreement and the same brokerage name showed up twice. My borrower has used this broker before and seems unbothered. The lender wants a written explanation from the borrower about how the purchase price was arrived at, basically asking him to show his work on the negotiation, because if the dual agent had any reason to push the price up, the collateral value question gets murkier. The ask-to-close spread was about $18k and my borrower says he did not push back much because the broker told him there was another offer. I have no way to verify that. I read both sides of this differently now than I did before the counsel flag. The loan is still moving but I am sitting with the question of whether I need a separate appraisal order rather than relying on the one that came through the broker's preferred vendor.
