Thinking about carrying the note on Maplewood myself and wondering what the dual agency angle actually does to that negotiation
The property is a 3/1 in Maplewood that I've been renting out and I'm considering whether to sell it clean at around 218k or carry a note at 6.5% on maybe 160k with the buyer putting 58k down. The listing agent already knows I'm the seller who might finance, which means if she brings the buyer too she knows the full picture on what terms I'd actually accept before the buyer sits down.
That asymmetry bothers me more in a seller-carry situation than it would in a straight sale. In a straight sale the negotiation is basically over when the price lands. Here the real back-and-forth is the rate, the balloon term, whether I get a personal guarantee, what happens on default. The agent knows I want the passive income more than the lump sum. She knows I've held the property since 2017 and my basis is low so I'm not desperate for the full 218. Any of that leaking into how she frames the deal to a buyer she's also representing is a problem I can't really audit after the fact.
I do my own appraisal work so I can price the asset. What I can't price cleanly is whether a dual agent running both sides of a seller-finance negotiation is going to shade the note terms against me because her fee is easier to close if the buyer gets a softer deal. The flat purchase price doesn't move much but a half point on the rate over a 5-year balloon on 160k is around 4k, and that's before I get into what the balloon period looks like.
Has anyone structured a seller carry where the listing agent also brought the buyer and come out thinking the note terms were actually clean.
