When a JV partner has the seller and I have the buyer, who actually controls the deal
The answer I keep landing on is whoever can be replaced first. If the seller will talk to anyone who calls with the right price, the seller-side partner is more exposed than they think. If the buyer is a cash fund buying volume in that zip, they probably have three other wholesalers feeding them and the buyer-side partner is just as replaceable. The split negotiation usually happens before either partner has worked out which role is actually scarce on that specific deal, and that seems like exactly backwards order. A seller deep in probate who will only deal with the one person who built the relationship over six months is a different situation than a cold-list seller who signed because someone caught them on the right day. Same logic applies to the buyer end: a longtime relationship with a serious operator who trusts your judgment on ARV is different from a name on a cash buyer spreadsheet. What I actually want to know is whether people here set the split before the deal or after they have mapped out which side could fall apart without the partner holding it.
