A severed mineral half and a pipeline easement took 11 acres from $74,500 to $61k
First parcel, first anything. Asking was $74,500 for 11 acres about 40 minutes past the last subdivision on a state route, gently rolling, county road frontage on the north side. I bought it to sit on.
I don't know how to do most of this yet so I did the one thing I could do, which was read every page of the title commitment and then go find the underlying documents at the recorder's office. Took me two evenings and a Saturday.
Two things came out of it.
One, a 1963 warranty deed reserved half the mineral interest to a family that has since split it among what looks like at least nine heirs. That reservation carried forward through every conveyance after and nobody in the marketing chain mentioned it. There's also an oil and gas lease recorded in 1981 that I believe is expired for lack of production, but the release was never recorded, so it's still sitting on the title as an exception.
Two, a 30 foot gas transmission easement running roughly northwest to southeast across what is, obviously, the flattest and most obviously buildable 3 acres. Recorded 1978, with language about the grantee's right of ingress and egress over the remainder of the property for maintenance, which is broader than the 30 feet.
I brought both to the seller's agent with the recorded documents attached. The mineral reservation they knew about and shrugged at. The easement location they genuinely did not know, because the survey on file was old and the easement wasn't plotted on it. I asked for a new survey with the easement plotted, seller paid, and it came back showing the easement clipping 1.9 acres of usable ground and sitting almost exactly where a driveway would want to go.
Closed at $61,000. $5,545 an acre against $6,772 asking. Taxes are $430 a year and I have that funded for a long time because it's a small number.
What nearly broke it: I almost skipped the recorder's office. The commitment listed both exceptions as document numbers with no description. If I'd only read the commitment page I'd have seen two line items that meant nothing to me and closed at asking.
What I don't know is how much the mineral half actually costs me over a long hold, and whether the unreleased 1981 lease is a real problem or a paperwork problem.
