Has anyone closed a land assignment where the parcel had a tax lien from a prior owner that the county never released after the estate sale
Picked up a contract on 22 acres outside Yelm about six weeks ago, seller is an older woman who inherited it from her uncle in 2019. The estate went through probate, deed transferred fine, and she has been paying the property taxes every year since. But I pulled the full title chain last week and there is a 2011 county tax lien from when the uncle stopped paying for about three years before he died. The probate attorney apparently handled the deed transfer and the personal representative signed everything correctly, but nobody went back and got the county to formally release that old lien on record. It is sitting there in the chain from 11 years ago, still open on county records, even though the estate actually paid the outstanding balance in 2020 as part of probate settlement. The seller has a receipt from the county treasurer and a line item in the probate accounting showing the payoff. The county just never recorded a release.
My end buyer is a guy who builds small cabin retreats and he wants to close in the next 30 days. My assignment fee is 14,500 on a spread between 58k and 80k. The title company flagged it this morning and said they will need a recorded release before they can insure. So now I am trying to figure out how long it actually takes to get a county treasurer's office to produce and record a formal lien release when you have proof of payoff but no release document. Pierce County has been decent in my experience but Thurston County is slower. Anyone dealt with this exact situation where probate paid the debt but the release just never got filed?
