Is there a way to figure out if timber rights are separate before I lock up a parcel
Talking to a seller right now on 47 acres in a rural county about two hours from me, asking $31,000. Sounds fine until I started reading about timber severances and now I don't know if the standing timber is even part of what she's selling. She doesn't know either. The county recorder's office here is not digitized past about 1987 and this parcel has been in the family since the 60s. I can get a title search done for around $275 through the same company I used on a smaller lot last month, but that search came back in 11 days and my inspection period is only 14. If there's a recorded timber deed or a severance I need someone who actually reads the old deed language to catch it, and I don't know if the standard search covers that or if I need to pay more for a full abstract going back further. The other option is I write a contingency into the contract that specifically covers merchantable timber being included in the conveyance, but if the buyer I have lined up for this type of acreage is planning to log a portion of it to offset his cost, a contingency that voids on timber issues just kills the deal before it starts rather than protecting me. Trying to figure out whether $275 and 11 days is even the right tool here or if I need a full abstract that runs closer to $600 and three weeks, which puts me past my window anyway.
