Does anyone have a medical office note inside a mezz stack and can walk me through what the intercreditor actually restricted you from doing
I am looking at a mezz position on a two-tenant MOB in the Nashville suburbs, about 18,000 square feet, and the senior lender is a regional bank I have not worked with before. I have done gap funding on residential flips where the intercreditor was basically one page and nobody fought about it, but I am told commercial MOB mezz is a different animal and that some of these agreements will bar you from taking action on your collateral for so long that the asset has already deteriorated before you can move. What I cannot figure out is whether that standstill period is typically negotiated down or whether the senior just hands you language and it is close to take it or leave it at this loan size, which is roughly $4.2M senior and the mezz slot is around $800K. I lost the GP deal where I thought I had protection and found out at distribution that the waterfall language I signed meant nothing recoverable for me, so I am not walking into another document I do not understand. Specific experiences with what you actually got restricted from doing, and over what timeframe, would mean more to me right now than general framing.
