What a seller gives up under an exclusive right to sell listing agreement
A builder starting to look at the sell side, wanting to understand who the houses get handed to, gets a sample listing agreement from an agent. It says "exclusive right to sell" at the top with a 6 month term. The plain reading is that the agent is the only one who can sell it. The version that circulates at supply yards is that it means the agent gets paid even if the owner finds the buyer, which sounds absurd on first hearing. If the neighbor walks over and buys the house, why is anyone owed a commission? The same agreement had a line about compensation offered to a cooperating broker, left blank with a note saying it would be discussed. If the MLS is no longer allowed to carry that, why is it on the paper at all?
