Heirs gap from 1978 and a neighbor's gravel drive across the corner
40 acres, contract price $128,000, mostly wooded with about 6 tillable acres. Title commitment came back with two things I don't like. First, a deed out of an estate in 1978 with no probate in the county records, so the chain runs through what looks like an heirs conveyance signed by three of what may have been four children. The fourth is unaccounted for. Second, a neighbor's gravel drive cuts the northeast corner for maybe 400 feet, no recorded easement, and the seller says it's been there since he was a kid.
Attorney quoted $6,500 to $9,000 for quiet title including service by publication, and said 8 to 14 months is normal here. Seller won't pay for it and won't extend past 60 days. I'm buying for cash so no lender to satisfy.
What I want to understand is whether quiet title actually solves both problems or just the first one, and whether a judgment gets me an insurable title at the end or just a piece of paper.
