Carried a note on a student rental once and the guarantor question kept me up for six weeks before I signed anything
The property was a four bed near NC State, 2021, and I had already decided I was not going to sell it outright because the basis was low enough that a seller-financed deal made more sense on paper. Buyer was a 24-year-old with a decent down payment and a father who said he would co-sign. What I did not fully think through until I was deep in the attorney fees was what the note actually looked like if the son stopped paying and the father disputed the guarantee language. My attorney in Raleigh charged me $1,800 to tighten the personal guarantee so it survived a death or divorce on the guarantor side, and I still do not know if that would hold up because I have never had to test it. The buyer has paid on time for two years. I am watching it. The reason I keep thinking about this now is that I have a three bed in Maplewood I am considering the same structure on, and the tenant pool there skews even younger, which means the guarantor conversation is going to happen again. Anyone who has actually called a guarantor on a student-adjacent seller-financed note, I want to know how that conversation went and whether the paperwork you had was enough.
