Contract says "and/or assigns" but the seller's agent crossed it out
Rehab guy here, mostly I get called after someone else has locked a house up. But a seller found me directly through a mailer test I was running and I'm trying to do this one as a wholesale instead of taking it on myself, because the scope is way past what I want right now.
I used a purchase agreement with my name followed by "and/or assigns" on the buyer line, because everything I read says that's what makes a contract assignable. Seller has a listing agent involved (long story) and she struck it out and wrote "buyer may not assign" in the margin, then initialed it. Seller signed under that.
So do I still have something? Someone on another forum told me equitable interest exists regardless of what the contract says and I can assign anyway. That sounded wrong to me but I don't actually know why it's wrong.
