Listing agent offered a point off if she brings the buyer herself
9-unit, 1960s brick, listed three weeks ago at $1.24M. Signed a 5% total commission, 2.5 each side. Rents are $8,900 a month, T12 NOI just under $84k, so I'm priced around a 6.7 going in and I know that's optimistic for this submarket.
Yesterday my listing agent called and said she has a buyer from a sale she closed last fall who is in a 1031 window and needs to identify by early next month. She'll cut the total commission to 4% if she writes both sides. Dual agency is legal here with written consent, and she sent me the consent form already.
The 1% is $12,400 in my pocket at that price. What I can't price is what I give up. She's had my file for three weeks. She knows my bridge loan matures in March, she knows I told her I'd take $1.18M on a fast close, and she knows the roof quote I got in January. None of that helps me if she's sitting between me and a buyer on a clock.
Three options I see. Take the 4% and dual agency. Tell her to refer the buyer to another agent for a referral fee and keep her on my side only. Or ask her broker for designated agency, second agent in the office for the buyer, and see whether the 1% survives that.
The consent form has one line about confidential information that I've read four times and still can't tell what it actually protects. What would you do with the March maturity sitting there?
