The sponsor's construction draw schedule was fiction and I got it wrong
Read the deck three times, asked about the draw schedule on a call, got a confident answer and took it. The actual draw schedule buried in the exhibit was tied to permits that had not cleared yet in Phoenix, and the mezz coupon was sized assuming the senior would fund on a rolling 30-day basis. It did not. Senior lender went to a 60-day hold after the first permit delay, the interest reserve burned faster than the waterfall assumed, and by month seven the sponsor was curing out of pocket on a property that still had no certificate of occupancy. I was not in this deal as an LP or as a mezz lender, I was watching a friend's position from the outside, but I had read the same documents and told her the draw schedule looked fine. That is the part I am sitting with. The permit status was checkable. The city of Phoenix posts that online. I did not check it. I read what the sponsor wrote about it instead of going to the source, and the source would have taken twenty minutes. She got her principal back when the sponsor eventually refinanced the whole thing in month 19, but the coupon accrued and she got paid at 1.09x on an 18-month hold at 13 percent. That is a bad outcome on a subordinate seat. Next time I look at a construction draw tied to permits I am pulling the permit record myself before I say anything to anyone.
