The servicer settled a workout without my authorization and I need to understand what that actually costs me
If a servicer agrees to a forbearance or loan modification with the borrower before the note holder signs off, the immediate damage is usually a locked-in payment path the holder never priced. Say the note was bought at 55 cents on a 90k UPB with a REO exit in mind at 62k. A servicer-approved 24-month forbearance now puts the holder in a re-performing position they never modeled, at a yield that may not cover the cost of funds, and the exit window narrows because the borrower has a new agreement in hand that complicates any foreclosure timeline started later. The deeper problem is the holder's standing if that modification gets recorded or acknowledged in writing. Some servicer agreements give them wide operational latitude, and what reads as "settlement authority" to the holder reads as "standard loss mitigation" to the servicer. The contract language is where this fight actually lives. Has anyone had to unwind a servicer-initiated modification, and if so, did your servicing agreement give you any practical remedy or just a right to terminate the servicer with the damage already done?
