Paid 7,400 to an agent who wrote one contract on a house I found myself
Signed an exclusive right to represent in January. Six months, area described as "the metro area and surrounding counties," 2% of purchase price. I read it, understood the words, and signed it anyway because I didn't think the scenario applied to me.
In March my neighbor mentioned that her cousin was selling a 370k three bedroom off market. I'd actually spoken to the cousin in December, before I signed anything, about a completely different property. I called my agent to ask a question about earnest money and she said she'd write it up. She wrote the offer, ordered nothing, attended nothing, and answered maybe six texts. Closed in April.
Fee at closing: 7,400. Seller was an individual with no listing agreement and no interest in paying a buyer's broker, so all of it came from my cash. I made the argument that I sourced the property and had contact with the seller before the agreement date. It went nowhere, and reading the clause again, it should have gone nowhere.
What it cost beyond the 7,400: the roof needed about 9k of work and I had 11k after closing, so I did the cheap patch instead and I'll be doing the real roof next spring at whatever prices are then.
What I'd do differently: at signing, attach a written list of properties and sellers I'd already been in contact with, excluded from the agreement. And I'd narrow "the metro area and surrounding counties" to the four towns I was actually shopping. Both of those are one sentence each and I had them in front of me in January.
