Does the servicer actually have to respond to me or am I just hoping they do
Bought a first in Ohio six weeks ago, $34k into a note with a $71k UPB on a property that last sold for $88k in 2019. The servicer is SN Servicing out of Eureka and I have sent three written requests for payment history and an updated account statement. One acknowledgment email on day four, nothing since. My attorney says they are not legally obligated to respond to me on the same timeline they would to a borrower, which I did not fully think through before closing. I want to build out the reinstatement number and I cannot do that without a clean payment history going back to at least 2021 when the default started showing on the credit report. The prior servicer was Fay and there was a transfer mid-default, so there is a gap in the records I got from the seller too. Seller says it is a boarding issue and Fay will send it eventually. That was three weeks ago. I have a borrower who answered the phone and seems like he wants to work something out, and I am sitting here unable to tell him what he actually owes to reinstate because I do not have a number I trust. If anyone has dealt with SN on a transferred note specifically, I want to know how long this actually took to get sorted and whether there is a contact above the standard servicing line worth reaching.
