Contract on the kitchen table, or come back once title's back?
Sat with an owner at 27 days to the sale, motivated, no hostility, and I had a one page purchase agreement in the folder with a ten day diligence out. I didn't pull it out. Went home, ordered title, and by the time it came back four days later she'd talked to somebody else and wanted 9k more.
So I've been arguing with myself since. The case for signing on the first visit is that the window is fixed, an unsigned deal is an invitation for the next mailer to reprice it, and the diligence period is exactly the tool that lets you sign early and walk if the title is a mess. The case for waiting is that a contract you cancel in week two on a distressed owner is the thing that gets this whole strategy called predatory, and it hands your seller a reason to distrust the next investor. I've also seen people sign, tie the property up, and use the diligence window as free optionality while they shop the assignment, which I don't want to be.
My own diligence spend on these runs 1,200 to 2,600 before I know if it's real, so signing first is also what protects that money.
