Abatement threat over a bathroom fan on one unit while the other two pass
A scenario for the room. A housing authority does an annual on a three-unit. Units 1 and 2 pass. Unit 3 fails on bathroom ventilation, the fan runs but the inspector says it is not moving air, plus a cracked outlet cover. The notice gives 30 days, then the HAP payment stops accruing, and the authority says it does not get paid retroactively once abated. The questions are about the money mechanics rather than the repair. If abatement hits on unit 3, does that void the HAP contract on that unit or just suspend payment? If the tenant stays in place during abatement, who owes the abated portion, and can the owner bill the tenant for it? And is there any version where the authority reinstates payment back to the fail date once it passes reinspection, or is the gap simply gone? An owner in this spot also wants to know whether a failed unit in a building triggers extra scrutiny on the other two on the next cycle. Inspectors do tend to get more thorough after one bad unit, and it is worth knowing whether that is policy or just the same inspector remembering.
