Client wants to put an IRA into a property I'd be the listing agent on
Getting my license this year and a family friend asked me to help him buy a duplex inside his self-directed Roth. He's serious, has about $340k in the account, and wants to close this fall.
Here's what I flagged and can't resolve. He wants me to represent him as buyer's agent and collect the commission. I'm not related to him, no shared business, no ownership in his account. On its face I'm a third party being paid a market rate fee out of the transaction.
But two things bother me. First, he's also floated that once he's licensed himself (he's talked about it) he'd want to handle his own IRA purchases and collect the commission into the IRA. That seems like it walks straight into the disqualified person problem, and I'd rather understand why before I tell him no. Second, my brokerage's commission would be paid at closing out of the transaction proceeds, and I don't know whether an IRA purchase changes anything about how that gets documented when the buyer of record is a custodian FBO his account.
The live decision is whether I take the engagement at all. If there's any argument that a friend-of-the-family agent relationship creates a problem for his account, I don't want to be the reason a $340k Roth gets disqualified. That's not a risk I'm being paid enough to carry.
